If you are 17 and caught smoking underage, what will happen?

I think this is a very great question that I thought of. Since you're considered an adult in court when you are 17, what would happen if a cop catches you smoking and finds out you're 17 and gives you a ticket and you go to court and fight the ticket? Could you just tell the jury that since you are 17 you should be charged as an adult, which thus leads into no charge at all? Maybe? I think this could be a good debatable question!
